Because of the rising number of contested wills, more and more professionals are taking additional steps to ensure they’re carrying out their due diligence and creating bullet-proof case files.
This inevitably means more time needs to be spent creating detailed case notes, letters of wishes and extensive proofing to ensure you are minimising the chance of the will being contested down the line.
Thankfully, WillSuite has you covered. In this article we’re going to explore some of the ways the software can assist with preparing for will disputes.
WillSuite’s interaction log stores all of the communication you’ve had with the client. This means any emails, text messages and appointments sent via the system will appear there. Additionally, if you integrate your Office365 account with WillSuite, all existing emails with the client will be logged automatically. You’re also able to export the entire case interaction log via CSV, which saves a lot of time in the event of a Larke V Nugus request.
Another fantastic tool for professionals to rely on is the interview questions document. This document is automatically generated upon the creation of any will within WillSuite. It provides a detailed list of all the questions that have been asked, as well as the answers that the client has given. What makes this document particularly useful, is that it will automatically pull through ANY notes you’ve made while drafting. This means you can input a greater range of detail regarding the client’s wishes within the will itself to be exported in the event of a dispute.
With an increase in will disputes, many professionals are drafting letters of wishes in addition to the clients' will. This can help to provide clarity to many areas of the clients will and explain the decisions that have been made. Although a letter of wishes is not a legally binding document, it is a great document to provide additional detail about the decisions the client has made within their will. With WillSuite, the process of drafting a letter of wishes is as simple as possible thanks to our intuitive and dynamic questionnaire.
The testamentary capacity section of the will is an entire section where you are able to detail the health and mental capacity of the client. This intuitively designed section doesn’t take long to fill out, has a signing section for in-person consultations and once complete will pull through into the interview questions document to be easily downloaded at any time.
